SALE OF REAL PROPERTY
SUBJECT TO PERMISSIVE REFERENDUM
PUBLIC NOTICE is hereby given that the Town Board of the Town of Moira, New York, on January 14, 2025, adopted a resolution, subject to a permissive referendum a copy of which is as follows:
At a meeting of the Town Board of the TOWN OF MOIRA, Franklin County, New York, held at the Town Hall of said Town on the 14th day of January 2025.

In the matter of the sale of real property, for which all proceeds will be placed in the General Fund.
RESOLUTION #50-2025 OF THE TOWN BOARD OF THE TOWN OF MOIRA AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY OWNED BY THE TOWN
Motion by Councilman Snyder, seconded by Councilman Deuyour as set forth below:
DETERMINED AND ORDERED:
WHEREAS, on November 3, 1943, the Town of Moira acquired a parcel of property off the Conservation Road, Town of Dickinson, County of Franklin, State of New York, being Tax Map Parcel #164.-2-5, with such conveyance recorded by warranty deed filed with the Office of the Franklin County Clerk, Liber 389, Page 488, for its municipal purposes (the “Town Property”); and
WHEREAS, the Town Property consists of an area of land approximately 5 acres in size; and
WHEREAS, the Town Property is no longer needed for municipal purposes; and
WHEREAS, the Town Board has established the value of the Town Property to be $5,075.00 pursuant to a full market value estimate provided by the Assessor of the Town of Dickinson; and
WHEREAS, pursuant to New York State Town Law § 64(2), a Town Board may, upon the adoption of a resolution, convey or lease real property in the name of the town, which resolution shall be subject to a permissive referendum.
NOW THEREFORE, BE IT RESOLVED, that the Town Board declares this Town Property as surplus; and be it further
RESOLVED upon this resolution’s adoption, subject to permissive referendum, the Town Board will convey this property through an open competitive bid process awarded to the highest responsible bidder furnishing the required security after advertisement for sealed bids, with the minimum starting bid being the full market value estimate provided by the Assessor of the Town of Dickinson; and be it further
RESOLVED The Town Board authorizes the Town Supervisor to sign a contract and necessary documents to convey the Town Property to the awarded bidder, via warranty deed, subject to permissive referendum; and be it further
RESOLVED, the Town of Moira Town Clerk is hereby directed to publish notice of the conveyance of property for permissive referendum opportunity; and be it further
RESOLVED, that awarded bidder shall be required to bear any and all costs for the conveyance of said real property including but not limited to the survey, transfer tax, recording and filing fees.

Motion Carried (4 Ayes, 0 Nos) Supervisor Niles declared this resolution duly adopted subject to permissive referendum,
BE IT FURTHER DETERMINED AND ORDERED:
That this notice was published and posted as required by law and is otherwise sufficient.
THIS RESOLUTION IS SUBJECT TO A PERMISSIVE REFERENDUM.
The aforementioned resolution shall become final unless within thirty (30) days from this publication a petition protesting the order and requesting a referendum, signed and acknowledged by at least five percent (5%) of the owners of the taxable real property or one hundred such owners, whichever is the lesser, within the Town shall have been filed with the Town Clerk, Town of Moira
