PUBLIC NOTICE is hereby given that the Town Board of the Town of Moira, New York, on October 8, 2024, adopted a resolution, subject to a permissive referendum, a copy of which is as follows:

At a meeting of the Town Board of the TOWN OF MOIRA, Franklin County, New York, held at the Town Hall of said Town on the 8h day of October, 2024.

In the matter of the reduction from two Town Justices to one for the Town of Moira:

RESOLUTION #154-2024 OF THE TOWN BOARD OF THE TOWN OF MOIRA hereby reduces to one, the number of Town Justices for the Town of Moira, with the Town Justice position having an elected term of office expiring on December 31, 2024, being eliminated

Motion by Councilman Frank Snyder, seconded by Councilman Timothy Trimm as set forth below:

DETERMINED AND ORDERED:

WHEREAS, the Town of Moira currently has two elected Town Justices; and

WHEREAS, Towns in the County of Franklin with populations and sizes similar to those in the Town of Moira operate with a single justice; and

WHEREAS, the case load and amount of business handled in the Town Court of the Town of Moira is typical of those in similar towns with a single justice; and

WHEREAS, the Town Board of the Town of Moira has determined that it would be in the best interest of the Town to reduce the number of Town Justices from two to one in that there is presently no need for two Justices to handle the volume of matters in the Town Court of the Town of Moira; and

WHEREAS, the term of office of one of the elected Town Justices will expire on December 31, 2024, and now therefore be it

RESOLVED, pursuant to the provisions of New York Town Law Section 60-a(2), the Town of Moira hereby reduces to one, the number of Town Justices for the Town of Moira, with the Town Justice position having an elected term of office expiring on December 31, 2024, being eliminated; and be it further

RESOLVED, that this Resolution shall be subject to permissive referendum as provided by New York State Town Law Article 7, Section 90 through Section 94; and be it further 

RESOLVED, the Town Clerk is hereby authorized and directed to publish notice of this Resolution in the official newspaper of the Town within ten (10) days, and also within ten (10) days post on the website of the Town; and be it further

RESOLVED, that this resolution shall take effect on the thirtieth day, or upon such resolution having been approved by an affirmative vote of a majority of qualified electors of such town, if a valid petition be filed within the statutorily authorized time period forcing such question on the ballot at a general or special town election.

Motion Carried (5 Ayes, 0 Nos) Supervisor Niles declared this resolution duly adopted.

BE IT FURTHER DETERMINED AND ORDERED:

That this notice was published and posted as required by law and is otherwise sufficient.

THIS RESOLUTION IS SUBJECT TO A PERMISSIVE REFERENDUM.

The aforementioned resolution shall become final unless within thirty (30) days from this publication a petition protesting the order and requesting a referendum, signed and acknowledged by at least five percent (5%) of the owners of the taxable real property or one hundred such owners, whichever is the lesser, within the Town shall have been filed with the Town Clerk, Town of Moira
